MINISTERIO DE RELACIONES EXTERIORES Y MOVILIDAD HUMANA:
0000123 Suscríbase un Convenio Básico de Funcionamiento entre la República del Ecuador y la Organización no Gubernamental Extranjera Servicio Jesuita a Refugiados SJR. El propósito de esta resolución es formalizar la suscripción de un Convenio Básico con la finalidad de brindar protección a inmigrantes en situación irregular en el Ecuador. Se instruye a la dirección de Cooperación No Gubernamental y Evaluación para que elabore el proyecto correspondiente, se comunique con el representante de la organización para concretar la firma del convenio y, finalmente, notifique oficialmente la suscripción del mismo.

RESOLUCIÓN No. 018-2023 Refórmese la Resolución No. 008-2023 de 11 de julio de 2023, publicada en el Registro Oficial No. 373 de 14 agosto 2023 La resolución consiste en reformar el artículo 6 de la Resolución 008-2023 para cambiar la condición de nacionalización de contingentes arancelarios de arroz, estableciendo que deben ser embarcados antes del 31 de diciembre de 2023 en lugar de nacionalizados.

EL PLENO DEL COMITÉ DE COMERCIO EXTERIOR:
RESOLUCIÓN No. 019 – 2023 Emítese dictamen favorable para el inicio de negociaciones entre la República del Ecuador y República Dominicana previo a la suscripción de un Acuerdo Comercial, al amparo del Artículo XXIV del GATT y del Artículo V del AGCS. En la presente resolución, se aprueba el inicio de negociaciones comerciales entre Ecuador y República Dominicana, bajo el Artículo XXIV del GATT y el Artículo V del AGCS. Además, establece que las negociaciones deben cumplir con la Constitución de Ecuador y los objetivos del Plan Nacional de Desarrollo, sin afectar la aplicación del COPCI ni la adopción de medidas permitidas por la OMC.

SERVICIO NACIONAL DE CONTRATACIÓN PÚBLICA:
R.E-SERCOP-2023-0139 Incorpórese anexos técnicos a la Resolución No. RE-SERCOP-2023-0134 y expídense reformas a la Resolución No. RESERCOP-2023-0138 del Sistema Nacional de Contratación Pública. La presente resolución tiene por objeto aprobar y emitir anexos técnicos para la Normativa Secundaria del Sistema Nacional de Contratación Pública. Además, se incorporan definiciones relacionadas con ofertas extranjeras y nacionales. También se añaden anexos a la Resolución Externa No. RE-SERCOP-2023-0134, como la «Nómina de Accionistas» y modelos de contrato y acuerdo de integridad.

SERVICIO NACIONAL DE CONTRATACIÓN PÚBLICA:
RE-SERCOP-2023-0013 Expídese la política institucional en materia de gestión documental y archivo. La resolución establece la Política Institucional en materia de Gestión Documental y Archivo para el Servicio Nacional de Contratación Pública, definiendo directrices para la organización y conservación de documentos en formatos físicos y digitales. La política es de aplicación obligatoria para todos los servidores públicos del SERCOP, así como para contratistas y ciudadanos que interactúen con la institución y necesiten manejar documentación.

CB-MREMH-2023-018 Convenio Básico de Funcionamiento entre el Gobierno de la República del Ecuador y la Organización No Gubernamental Extranjera SWISSAID, Fundación Suiza de Cooperación al Desarrollo. El presente instrumento tiene como objetivo establecer los compromisos de obligatorio cumplimiento entre la organización gubernamental extranjera SWISSAID, que desarrolla actividades de cooperación internacional no reembolsable en el Ecuador, y el Ministerio de Relaciones Exteriores y Movilidad Humana.

Acuerdo:
MDT-2023-175 Fíjese el salario básico unificado del trabajador en general para el año 2023, en cuatrocientos sesenta dólares de los Estados Unidos de América (US$ 460,00) mensuales a partir del 01 de enero de 2023. Se acuerda fijar el Salario Básico Unificado para el año 2023 en $460 mensuales a partir del 1 de enero. El incremento respecto al año anterior es del 2,223%, aplicable también a la fijación de salarios mínimos sectoriales según las comisiones correspondientes.

PRESIDENCIA DE LA REPÚBLICA:
DECRETO:
Decreto No. 99. Expídense reformas al Reglamento para la Aplicación de la Ley de Régimen Tributario Interno y al Reglamento de Comprobantes de Venta, Retención y Documentos Complementarios. El decreto presenta las siguientes reformas: Primero, elimina un texto del último inciso del artículo 37 relacionado con la prescripción de la obligación tributaria. Segundo, sustituye el artículo 77, estableciendo nuevos plazos para el pago voluntario del anticipo del impuesto a la renta. Tercero, modifica el primer inciso del artículo 156, cambiando el plazo máximo de prescripción de la obligación tributaria de acuerdo con el Código Tributario por un plazo de siete años.

0000123 – Subscribe to a Basic Operational Agreement between the Republic of Ecuador and the Non-Governmental Organization Jesuit Refugee Service (SJR). The purpose of this resolution is to formalize the subscription of a Basic Agreement aimed at providing protection to immigrants in irregular situations in Ecuador. The Non-Governmental Cooperation and Evaluation Directorate is instructed to develop the corresponding project, communicate with the organization’s representative to finalize the agreement’s signing, and officially notify the subscription thereafter.

FOREIGN TRADE COMMITTEE:
RESOLUTION No. 018-2023 Amend Resolution No. 008-2023 dated July 11, 2023, published in Official Gazette No. 373 on August 14, 2023. The resolution aims to amend Article 6 of Resolution 008-2023 to change the nationality condition of tariff quotas for rice, establishing that they must be shipped before December 31, 2023, instead of being nationalized.

THE PLENARY OF THE FOREIGN TRADE COMMITTEE:
RESOLUTION No. 019-2023 Issue a favourable opinion for the commencement of negotiations between the Republic of Ecuador and the Dominican Republic, prior to the signing of a Trade Agreement, under Article XXIV of the GATT and Article V of the AGCS. In this resolution, the commencement of trade negotiations between Ecuador and the Dominican Republic is approved under Article XXIV of the GATT and Article V of the AGCS. It further specifies that the negotiations must adhere to Ecuador’s Constitution and the objectives of the National Development Plan, without compromising the implementation of COPCI or the adoption of measures allowed by the WTO.

NATIONAL PUBLIC PROCUREMENT SERVICE:
E-SERCOP-2023-0139: Incorporate technical annexes to Resolution No. RE-SERCOP-2023-0134 and issue amendments to Resolution No. RESERCOP-2023-0138 of the National Public Procurement System. This resolution aims to approve and issue technical annexes for the Secondary Regulations of the National Public Procurement System. Additionally, it incorporates definitions related to foreign and domestic bids. Annexes are added to External Resolution No. RE-SERCOP-2023-0134, such as the «Shareholder List» and models of contract and integrity agreement.

RE-SERCOP-2023-0013: Issuance of the institutional policy on document management and archives. The resolution establishes the Institutional Policy on Document Management and Archives for the National Public Procurement Service, defining guidelines for the organization and preservation of documents in physical and digital formats. The policy is mandatory for all public servants of SERCOP, as well as for contractors and citizens interacting with the institution who need to handle documentation.

CB-MREMH-2023-018 Basic Operating Agreement between the Government of the Republic of Ecuador and the Non-Governmental Foreign Organization SWISSAID, Swiss Foundation for Development Cooperation. This instrument aims to establish mandatory commitments between the foreign governmental organization SWISSAID, which conducts non-reimbursable international cooperation activities in Ecuador, and the Ministry of Foreign Affairs and Human Mobility.

MDT-2023-175: Set the unified basic salary for general workers for the year 2024 at four hundred and sixty United States Dollars (US$ 460.00) per month, starting from January 1, 2024. It is agreed to set the Unified Basic Salary for the year 2024 at $460 per month starting from January 1. The increase compared to the previous year is 2.223%, applicable also to the establishment of sectoral minimum wages according to the respective commissions.

DECREE:
Decree No. 99. Issuance of reforms to the Regulation for the Implementation of the Internal Tax Regime Law and the Regulation of Sales Receipts, Withholding, and Complementary Documents. The decree introduces the following reforms: First, it removes a text from the last paragraph of Article 37 related to the prescription of tax obligations. Second, it substitutes Article 77, establishing new deadlines for the voluntary payment of income tax advances. Third, it amends the first paragraph of Article 156, changing the maximum prescription period for tax obligations according to the Tax Code to a period of seven years.
