ACUERDO MINISTERIAL

ACUERDO MINISTERIAL Nro. MDT-2025-054
Se reforma la norma para la certificación de sustitutos de personas con discapacidad, estableciendo que la calificación de la discapacidad será realizada por el Ministerio de Salud Pública, eliminando la referencia a la Resolución No. 2013-0052 del CONADIS. Se redefine la discapacidad severa en función de niveles de gravedad y porcentaje, considerando discapacidad intelectual, psicosocial y múltiple grave, muy grave o completa desde el 50%, y discapacidad física, auditiva, visual y de lenguaje muy grave o completa desde el 75%. Se actualizan los requisitos documentales para la certificación de sustitutos directos de personas con discapacidad, exigiendo cédula de identidad que contenga la información de la discapacidad validada por el Ministerio de Salud Pública. Se dispone que, en un plazo de 30 días desde la suscripción del acuerdo, se actualice el módulo tecnológico correspondiente para aplicar esta normativa, y se establece que el acuerdo entra en vigencia desde su firma.

RESOLUCIÓN No. 005-NG-DINARP- 2025
Se establece que los aspectos técnicos, operativos y de seguridad del Sistema Integrador de Pagos (SIP) y la Red de Pagos Instantáneos (RPI) serán definidos por el Banco Central del Ecuador mediante documentos específicos que incluirán requisitos funcionales, manuales, estándares técnicos, ciberseguridad, autenticación, cifrado, trazabilidad y canales de conexión. La Gerencia de Supervisión e Innovación de Medios de Pago será responsable de monitorear la implementación y reportar avances. La Gerencia de Riesgos y la de Tecnologías de Información deberán emitir un documento interno con estándares de seguridad de la información y conexión. Las fechas de cumplimiento se regirán por lo indicado en el artículo 3. En el plazo de un mes desde la firma de esta norma, se deberá convocar al Comité Consultivo Interinstitucional de Pagos para coordinar la interoperabilidad de transferencias en tiempo real. La Resolución entra en vigor desde su suscripción, sin perjuicio de su publicación en el Registro Oficial.

SERVICIO NACIONAL DE DERECHOS INTELECTUALES
RESOLUCIÓN No. SENADI-DG-NT-2025-003-NT
La Norma Técnica regula el proceso de calificación, selección y presentación de la terna de auditores externos para las sociedades de gestión colectiva. La auditoría externa debe ser realizada por personas naturales o jurídicas calificadas por la Dirección Nacional de Derecho de Autor y Derechos Conexos y registradas ante la Superintendencia de Compañías. Estas auditorías deben presentarse durante los primeros cuatro meses del año y publicarse en la página web de la sociedad. La convocatoria para el examen será realizada en el segundo trimestre del año correspondiente y, de ser desierta, la Dirección Técnica presentará la terna directamente. Para calificar, los auditores deben cumplir requisitos académicos, experiencia, estar al día con sus obligaciones fiscales y no estar incursos en impedimentos legales o conflictos de interés. La calificación tendrá vigencia de tres años, renovable, y deberá mantenerse actualizada. La Dirección Técnica podrá suspender o retirar la calificación por incumplimiento, falsedad o faltas éticas. La selección final del auditor corresponde al Comité de Monitoreo de cada sociedad, escogido de una terna sorteada públicamente. El auditor externo tendrá la obligación de realizar su examen conforme a las Normas Internacionales de Auditoría, evaluar los controles internos, reportar irregularidades y conservar la documentación por cinco años. Los informes deben incluir dictamen, estados financieros completos y evidencia suficiente del trabajo realizado.

RESOLUCIÓN NRO. JPRF-T-2025-0156
La norma técnica establece el procedimiento para la calificación, selección y contratación de auditores externos que examinen los estados financieros de las sociedades de gestión colectiva, quienes deberán presentar sus informes en los primeros cuatro meses del año y publicarlos en su sitio web institucional. Podrán ejercer esta función solo personas naturales o jurídicas domiciliadas en Ecuador, debidamente calificadas por la Dirección Nacional de Derecho de Autor y Derechos Conexos y registradas ante la Superintendencia de Compañías. Se detallan requisitos específicos de formación académica, experiencia y documentación para acceder a dicha calificación, además de prohibiciones e impedimentos éticos, legales y de conflicto de interés. La calificación tiene una vigencia de tres años, es renovable, y los auditores deben mantener actualizada su información. En caso de incumplimiento, falsedad, faltas graves o impedimentos sobrevinientes, se prevé la suspensión o retiro definitivo de la calificación, previa notificación y derecho a defensa. La Dirección Técnica realizará la convocatoria en el segundo trimestre del año y sorteará una terna de auditores entre los calificados, de la cual cada sociedad seleccionará uno a través de su Comité de Monitoreo. El auditor solo podrá prestar servicios de auditoría externa a la sociedad por un máximo de tres años consecutivos. Se enumeran las obligaciones del auditor, que incluyen realizar el examen conforme a normas internacionales, evaluar los sistemas contables y de control interno, emitir informes completos y fundados, comunicar irregularidades detectadas y conservar evidencias del trabajo por cinco años.

MINISTERIAL AGREEMENT No. MDT-2025-054
The regulation for the certification of substitutes for persons with disabilities is amended, establishing that the assessment of the disability shall be carried out by the Ministry of Public Health, and eliminating the reference to Resolution No. 2013-0052 issued by CONADIS. Severe disability is redefined based on severity levels and percentage, considering intellectual, psychosocial, and multiple disabilities as severe, very severe, or complete starting from 50%, and physical, hearing, visual, and speech disabilities as very severe or complete starting from 75%. The documentary requirements for the certification of direct substitutes for persons with disabilities are updated, requiring an identity card that includes disability information validated by the Ministry of Public Health. It is established that, within 30 days from the signing of the agreement, the corresponding technological module must be updated to implement this regulation, and that the agreement shall enter into force upon its signature.

RESOLUTION No. 005-NG-DINARP-2025
It is established that the technical, operational, and security aspects of the Integrated Payment System (SIP) and the Instant Payment Network (RPI) shall be defined by the Central Bank of Ecuador through specific documents that will include functional requirements, manuals, technical standards, cybersecurity, authentication, encryption, traceability, and connection channels. The Management of Payment Means Supervision and Innovation shall be responsible for monitoring the implementation and reporting progress. The Risk Management and Information Technology Management departments shall issue an internal document establishing information security and connection standards. Compliance deadlines shall be governed by the provisions set forth in Article 3. Within one month from the signing of this regulation, the Interinstitutional Payments Advisory Committee must be convened to coordinate the interoperability of real-time transfers. This Resolution shall enter into force upon its signature, without prejudice to its publication in the Official Register.

The Technical Standard regulates the process of qualification, selection, and submission of the shortlist of external auditors for collective management societies. The external audit must be conducted by natural or legal people qualified by the National Directorate of Copyright and Related Rights and registered with the Superintendence of Companies. These audits must be submitted within the first four months of the year and published on the society’s website. The call for the examination will be made during the second quarter of the corresponding year, and if no candidates are presented, the Technical Directorate shall directly submit the shortlist. To qualify, auditors must meet academic requirements, possess relevant experience, be current with their tax obligations, and have no legal impediments or conflicts of interest. The qualifications shall be valid for three years, renewable, and must be kept up to date. The Technical Directorate may suspend or revoke the qualification due to non-compliance, falsehood, or ethical violations. The final selection of the auditor shall correspond to the Monitoring Committee of each society, chosen from a publicly drawn shortlist. The external auditor is obligated to conduct their examination in accordance with the International Standards on Auditing, assess internal controls, report irregularities, and retain documentation for five years. The reports must include an opinion, complete financial statements, and sufficient evidence of the work performed.

The technical standard establishes the procedure for the qualification, selection, and contracting of external auditors who examine the financial statements of collective management societies. These auditors must submit their reports within the first four months of the year and publish them on their institutional website. Only natural or legal persons domiciled in Ecuador, duly qualified by the National Directorate of Copyright and Related Rights and registered with the Superintendence of Companies, may perform this function. Specific requirements regarding academic training, experience, and documentation to obtain such qualification are detailed, along with prohibitions and ethical, legal, and conflict of interest impediments. The qualification is valid for three years, renewable, and auditors must keep their information up to date. In cases of non-compliance, falsification, serious misconduct, or subsequent impediments, suspension or permanent revocation of the qualification is provided, following notification and the right to defense. The Technical Directorate will issue the call during the second quarter of the year and will draw up a shortlist of auditors from the qualified candidates, from which each society shall select one through its Monitoring Committee. The auditor may provide external audit services to the society for a maximum of three consecutive years. The auditor’s obligations are listed, including conducting the examination in accordance with international standards, evaluating accounting and internal control systems, issuing comprehensive and well-founded reports, communicating detected irregularities, and retaining evidence of the work performed for five years.
