ACUERDO MINISTERIAL

ACUERDO MINISTERIAL N.º MEM-MEM-2025-0018-AM
Se dispuso, a través del Acuerdo Ministerial Nro. MEM-MEM-2025-0018-AM, a la Agencia de Regulación y Control Minero la reapertura del Catastro Minero, en el plazo de hasta 15 días a partir de la vigencia del Acuerdo. Esta apertura, según indica la disposición, se dará de forma gradual y progresiva, y se enfoca en el registro y otorgamiento de nuevas concesiones mineras, dando inicio para ello con la minería a pequeña escala no metálica. Por otra parte, se dispuso que el Ministerio de Energía y Minas, así como la Agencia de Regulación y Control Minero, sean los encargados de forma permanente de regular el funcionamiento del Catastro Minero Nacional, observando los principios de eficacia, eficiencia y transparencia. Finalmente, se dispuso que para el funcionamiento del Catastro se mantenga presente el derecho a la primera opción de Empresa Nacional Minera ENAMI EP.

MINISTERIO DE RELACIONES EXTERIORES Y MOVILIDAD HUMANA
ACUERDO MINISTERIAL N.º 0000057
En atención al conflicto armado entre Israel y Palestina y aquellos ataques producto de este, se ha dispuesto, en colaboración con las embajadas ecuatorianas en Israel y Palestina la gestión prioritaria y atención de ecuatorianos residentes y no residentes radicados en estos países, para lo cual deberán preparar mecanismos efectivos y eficientes que aseguren la integridad de los ecuatorianos en el exterior. Esta disposición mantiene como enfoque especial precautelar a aquellos ecuatorianos que, producto del conflicto, hayan quedado en situación de vulnerabilidad. Para ello, se dispuso que el Ministerio de Economía y Finanzas asigne, en coordinación con la Coordinación General y Administrativa Financiera, los recursos necesarios.

MINISTERIO DE RELACIONES EXTERIORES Y MOVILIDAD HUMANA
ACUERDO DE TRANSPORTE AÉREO ENTRE EL GOBIERNO DE LA REPÚBLICA DEL ECUADOR Y EL GOBIERNO DE LA REPÚBLICA DE CHILE
Se suscribió un acuerdo bilateral entre los gobiernos del Ecuador y de Chile con miras hacia mejorar las relaciones entre ambos países en materia aeronáutica. Dicho acuerdo establece mecanismos que permitan un crecimiento de las rutas aéreas comerciales y no comerciales y el tránsito por vía aérea de personas y mercancías. El Acuerdo también establece los mecanismos de seguridad a seguirse, buscando el reconocimiento de certificaciones, licencias y permisos para la realización de operaciones aéreas. Por otra parte, las Partes han llegado a un acuerdo con respecto de la exención de los derechos aduaneros, honorarios de inspección y otros derechos, siempre con sujeción a la reciprocidad, razonabilidad y no discriminación. Finalmente, el Acuerdo propicia un ambiente idóneo para la competitividad de aerolíneas y servicios de transporte aéreo, además de reducir los importes, tasas y tarifas, así como simplificar la tramitación de permisos de funcionamiento y certificaciones necesarias para que aerolíneas extranjeras protegidas por el Acuerdo se asienten en los países parte.

BANCO CENTRAL DEL ECUADOR
RESOLUCIÓN ADMINISTRATIVA N.º BCE-GG-011-2025
Se establecen los procedimientos que deberán cumplir las Entidades Financieras para realizar depósitos o retiros de billetes y monedas en el Banco Central del Ecuador. La resolución provee de definiciones claras con respecto de los términos referentes a la circulación monetaria a través del Banco Central, así como determina el procedimiento a seguir, responsabilidades de las Entidades Financieras y las consideraciones a tener durante el procedimiento. No obstante, también se establece que el método a seguir será el método PEPS (primero en entrar, primero en salir), así como un procedimiento claro en caso de que los clientes de las Entidades Financieras hagan uso de especies monetarias presuntamente falsas. Finalmente, y sin perjuicio de los protocolos de seguridad y verificación de la masa monetaria en circulación, la Resolución determina los plazos para actualizar los procedimientos, instructivos y demás documentos operativos del Banco Central del Ecuador relacionados a la normativa emitida.

MINISTERIAL AGREEMENT No. MEM-MEM-2025-0018-AM
By means of Ministerial Agreement No. MEM-MEM-2025-0018-AM, the Mining Regulation and Control Agency was ordered to reopen the Mining Cadastre within a period of up to fifteen (15) days from the effective date of the Agreement. Such reopening, as provided therein, shall be carried out gradually and progressively, focusing on the registration and granting of new mining concessions, commencing with small-scale non-metallic mining. Furthermore, it was ordered that the Ministry of Energy and Mines, as well as the Mining Regulation and Control Agency, shall be permanently responsible for regulating the operation of the National Mining Cadastre, in observance of the principles of effectiveness, efficiency, and transparency. Finally, it was established that, for the operation of the Cadastre, the right of first refusal of the National Mining Company ENAMI EP shall be upheld.

In response to the armed conflict between Israel and Palestine and the attacks resulting therefrom, it has been ordered, in collaboration with the Ecuadorian embassies in Israel and Palestine, to give priority management and assistance to Ecuadorians residing and non-residing in these countries. To this end, effective and efficient mechanisms must be prepared to ensure the safety and integrity of Ecuadorians abroad. This measure places special precautionary focus on Ecuadorians who, as a result of the conflict, are in a situation of vulnerability. For this purpose, it was ordered that the Ministry of Economy and Finance, in coordination with the General and Financial Administrative Coordination, allocate the necessary resources.

AIR TRANSPORT AGREEMENT BETWEEN THE GOVERNMENT OF THE REPUBLIC OF ECUADOR AND THE GOVERNMENT OF THE REPUBLIC OF CHILE
A bilateral agreement was signed between the Governments of Ecuador and Chile aimed at improving relations between the two countries in the field of aviation. This agreement establishes mechanisms to enable the growth of commercial and non-commercial air routes, as well as the air transit of persons and goods. The Agreement also establishes the security mechanisms to be followed, aiming at the recognition of certifications, licenses, and permits for the conduct of air operations. Furthermore, the Parties have reached an agreement regarding the exemption from customs duties, inspection fees, and other charges, always subject to reciprocity, reasonableness, and non-discrimination. Finally, the Agreement fosters a favorable environment for the competitiveness of airlines and air transport services, as well as reduces fees, charges, and tariffs, and simplifies the processing of operating permits and necessary certifications for foreign airlines protected under the Agreement to establish themselves in the Parties’ countries.

ADMINISTRATIVE RESOLUTION No. BCE-GG-011-2025
The procedures that financial institutions must follow to make deposits or withdrawals of banknotes and coins at the Central Bank of Ecuador are hereby established. The resolution provides clear definitions regarding terms related to the circulation of currency through the Central Bank, and establishes the procedures to be followed, the responsibilities of financial institutions, and the considerations to be observed during the process. Additionally, it establishes that the FIFO method (first in, first out) shall be applied, along with a clear procedure in the event that clients of financial institutions use allegedly counterfeit currency. Finally, without prejudice to the security and verification protocols for currency in circulation, the Resolution sets deadlines for updating procedures, instructions, and other operational documents of the Central Bank of Ecuador related to the issued regulation.
